Élevé operates byeleve.com, offering luxury home fragrances, candles, diffusers, and accessories.
By browsing our site, creating an account, or placing an order, you agree to these Terms and all policies referenced, including our Privacy Policy and Return & Exchange Policy.

2. ELIGIBILITY & ACCOUNT SECURITY
You must be 18 years or older to purchase from Élevé. You agree you are purchasing for personal use and not for unauthorized resale.
If you create an account, you are responsible for safeguarding your credentials and any activity under your account. Notify us immediately of unauthorized access.
We may suspend or terminate access at our discretion, including in cases of fraud, abuse, or violations of these Terms.
3. PRODUCTS, PRICING & AVAILABILITY
Élevé products are intended for personal enjoyment and ambient use only. Always follow the care and usage instructions provided with each product.
Discontinue use immediately if irritation or discomfort occurs. Élevé products are not intended to diagnose, treat, cure, or prevent any medical condition. Individual scent perception, skin chemistry, and sensitivity may vary.
Usage instructions may differ by product type, including fine fragrance, home fragrance, diffusers, and candles. Please review the specific guidance included with each item prior to use.
Élevé does not collect or store health or medical information related to fragrance sensitivities, allergies, or skin conditions.
Élevé products are created for intentional use and sensory enjoyment. Please follow the guidelines below to ensure safe use, optimal performance, and longevity across all formats.
Home Fragrance
Élevé home fragrance products are designed for ambient scenting and atmospheric use only.
Candles
Burn within sight and never leave unattended
Trim wick to approximately 5mm before each use
Allow wax to melt evenly across the surface during the first burn
Keep away from drafts, flammable materials, children, and pets
Discontinue use when wax reaches approximately 10mm from the base
Reed Diffusers
Place on stable, protected surfaces away from heat and direct sunlight
Avoid contact with skin, eyes, fabrics, and finished or delicate surfaces
Wash hands after handling reeds
Flip reeds only as needed to refresh scent
Keep out of reach of children and pets
E-Diffusers and Electric Scent Devices
Use only with Élevé-approved oils or refills
Follow all manufacturer instructions provided with the device
Do not overfill reservoirs
Disconnect from power before refilling or cleaning
Keep away from water, heat sources, children, and pets
Volcanic, Stone, and Passive Diffusers
Intended for ambient diffusion only
Apply fragrance gradually to avoid oversaturation
Place on non-porous, protected surfaces
Avoid direct contact with skin, textiles, or finished surfaces
Performance may vary depending on airflow and environment
Incense
Burn only in a suitable heat-resistant holder
Use on a stable, fire-safe surface
Never leave burning incense unattended
Ensure ash falls onto a protected surface
Keep away from drafts, flammable materials, children, and pets
Refills
Designed for use with corresponding Élevé vessels and devices only
Avoid mixing with non-Élevé products or liquids
Store upright in a cool, dry place away from heat and sunlight
Keep sealed when not in use

Discontinue use if irritation occurs

4. ORDERS & PAYMENT
Your order represents an offer to purchase. Élevé may accept or decline at our discretion due to:
inventory limits, payment issues, suspected fraud, pricing errors, or unauthorized resale concerns.
We accept the payment methods displayed at checkout (Stripe, PayPal, Shop Pay).
Customers are responsible for all applicable duties, taxes, and import fees.
5. SHIPPING & DELIVERY
Shipping options appear at checkout. Delivery times are estimates, not guarantees.
Certain fragrance products must ship via ground transportation due to carrier regulations.
Risk of loss transfers to you once the carrier receives the package.
Inspect packages upon delivery and report damage promptly per our Return & Exchange Policy.
6. RETURNS, EXCHANGES & ORDER CHANGES
Change of mind: 7 days from delivery (unused, unopened, seals intact).
Quality concerns: Contact us according to our Return & Exchange Policy timelines.
Order edits/cancellations: Only possible before fulfillment begins; email immediately.

7. THIRD-PARTY SERVICES

8. EXPORT CONTROLS & SANCTIONS
You represent that you are not located in a sanctioned region and are not a prohibited party under applicable export control laws.
You agree to comply with all export and sanctions regulations.
9. INTERNATIONAL ORDERS
International customers are responsible for customs duties, taxes, import clearance, and compliance with local regulations.
Some products cannot ship to certain regions due to restrictions.
10. PROMOTIONS, GIFT CARDS & SPECIAL OFFERS
Promotional codes are single-use unless otherwise stated, non-transferable, and may not be applied retroactively to past purchases.
Gift sets must be returned complete, unused, and in their original packaging.
Gift cards, if offered, are non-refundable and have no cash value except where required by law.
If a return causes an order to fall below a promotional threshold (including free shipping or bundled pricing), the refund amount may be adjusted accordingly.
10A. SUBSCRIPTIONS & PRE-ORDERS
Élevé may offer certain products through recurring subscription offerings (“Rituals”) or limited pre-order releases.
By enrolling in a Ritual or placing a pre-order, you agree to any program-specific details disclosed at checkout, which may include:
Estimated shipping windows for pre-orders (subject to change)
Advance notice of material delays, with the option to cancel prior to shipment
Subscription pricing, product rotation, or format updates communicated ahead of fulfillment
Ritual contents may evolve over time to reflect seasonal curation, ingredient availability, and Élevé’s creative direction. Any changes will honor the intent and value of the Ritual experience.

10B. RITUAL BILLING, CANCELLATION & RENEWAL TERMS
Unless otherwise stated at enrollment, the following terms apply to all Ritual subscriptions:
Automatic Renewal
Rituals renew automatically at the cadence selected during checkout. Your chosen payment method will be charged at the beginning of each billing cycle unless the Ritual is paused or cancelled.
Cancellation Window
You may pause or cancel your Ritual at any time prior to the next billing date through your Élevé account.
Cancellations apply to future billing cycles only. Charges already processed are non-refundable.
Price Adjustments
If Ritual pricing changes, you will be notified in advance and given the opportunity to cancel before the updated pricing takes effect.
Failed Payments
If a payment cannot be processed, we may attempt to retry the charge or temporarily pause your Ritual until updated payment information is provided.
Modifications
You may update delivery frequency, scent selections, or shipping details through your Élevé account or by contacting customer support prior to your next billing cycle.
11. ORDER LIMITS & RESALE PROTECTION
To protect our brand integrity, we may limit quantities per customer, household, or address.
Unauthorized resale or suspected resale may result in order cancellation.
12. PRODUCT SAFETY & CARE
Our products are intended for personal enjoyment and ambient use only. Always follow provided care instructions. Discontinue use if irritation occurs. Products are not intended to diagnose, treat, cure, or prevent any condition.Individual scent perception and skin chemistry may vary.

For candles:

13. USER-GENERATED CONTENT & REVIEWS
By submitting, posting, or sharing reviews, images, scent impressions, or other content with Élevé, including by tagging or mentioning us on social platforms, you grant Élevé a non-exclusive, worldwide, royalty-free license to repost or display such content in organic, editorial, or community contexts, such as our website, email newsletters, or social media channels.
All reposted user-generated content will be shared with clear attribution to the original creator wherever reasonably possible. Attribution may vary only where platform or format limitations apply.
This permission does not include paid advertising, sponsored placements, or other commercial promotional uses.
Any use of user-generated content for paid media, advertisements, or promotional campaigns will require separate, explicit consent or a written agreement with the content creator prior to use.
Creators retain full ownership of their content and may use, publish, or license it elsewhere without restriction.
If you prefer that your content not be reposted by Élevé, you may contact us at [email protected], and we will make reasonable efforts to remove future use.
By submitting reviews or scent impressions, you acknowledge that fragrance perception is subjective and that individual experiences may vary.
You represent that you own or have the necessary rights to all content you submit and that it does not infringe upon any third-party rights.
Élevé reserves the right to curate, moderate, or remove user-generated content at its discretion.
14. INTELLECTUAL PROPERTY
All content on this Site, including but not limited to trademarks, product names, fragrance names, images, text, designs, and visual elements, is owned by or licensed to Élevé and is protected by applicable intellectual property laws.
This includes, without limitation, fragrance compositions, scent concepts, ritual frameworks, subscription structures, editorial content, written narratives, and sensory or experiential concepts developed by Élevé.
Use of this Site and its content is permitted for personal, non-commercial purposes only.
Any reproduction, distribution, scraping, modification, or creation of derivative works, in whole or in part, without prior written consent from Élevé is strictly prohibited.

Our total liability for any claim will not exceed the amount paid for the product(s) in question.
19. FORCE MAJEURE
We aren’t liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, war, labor issues, and supply chain disruptions.
20. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Tanzania, and where applicable to U.S. transactions, the laws of Delaware, USA.
You agree to the exclusive jurisdiction of courts in:
Dar es Salaam, Tanzania, and
Delaware, USA (for U.S. customers).
EU/UK consumers may bring claims within their country of residence where local law requires.

21. CHANGES TO TERMS

22. INDEMNIFICATION
You agree to indemnify and hold harmless Élevé, its employees, and affiliates from claims arising from:

23. MISCELLANEOUS
If any provision of these Terms is deemed unenforceable, the remaining provisions will continue in full force and effect.
